Terms of Service

By accessing or using The Pickle Nest ("Platform," "we," "our," or "us") at thepicklenest.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform. These Terms apply to all visitors, registered users, and anyone who accesses or uses the Platform.

You must be at least 13 years old to use The Pickle Nest. By using the Platform, you represent that you are at least 13 years of age. If you are between the ages of 13 and 18, you may only use the Platform with the consent and supervision of a parent or legal guardian. We reserve the right to terminate accounts of users who misrepresent their age.

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to: • Provide accurate and complete information when creating your account • Keep your account information up to date • Immediately notify us of any unauthorized use of your account • Not share your login credentials with any third party

Account authentication is managed by Clerk. We are not responsible for breaches resulting from your failure to maintain account security.

You agree to use The Pickle Nest only for lawful purposes and in accordance with these Terms. You agree NOT to: • Harass, bully, intimidate, or harm other users • Post false, misleading, defamatory, or inappropriate content • Impersonate any person or entity • Attempt to gain unauthorized access to any part of the Platform or its related systems • Use automated scripts, bots, or scrapers to access the Platform without our express written consent • Transmit spam, viruses, malware, or any code of a destructive nature • Collect personal data from other users without their consent • Violate any applicable local, state, national, or international law or regulation • Use the Platform in any way that could disable, overburden, or impair it

We reserve the right to terminate or suspend accounts that violate these restrictions at any time without notice.

THE PICKLE NEST IS AN INFORMATION AND DISCOVERY PLATFORM. WE DO NOT ORGANIZE, HOST, SUPERVISE, OR CONTROL PICKLEBALL GAMES OR EVENTS. WE MERELY PROVIDE TOOLS FOR USERS TO DISCOVER AND CONNECT WITH LOCAL PICKLEBALL ACTIVITY.

PARTICIPATION IN PICKLEBALL AND ANY OTHER PHYSICAL ACTIVITY CARRIES INHERENT RISKS OF INJURY, INCLUDING SERIOUS INJURY OR DEATH. BY USING THE PLATFORM TO FIND OR JOIN GAMES, YOU ASSUME ALL RISKS ASSOCIATED WITH PHYSICAL ACTIVITY.

THE PICKLE NEST IS NOT RESPONSIBLE FOR ANY INJURY, DEATH, PROPERTY DAMAGE, OR OTHER HARM THAT OCCURS DURING OR IN CONNECTION WITH ANY PICKLEBALL GAME, EVENT, MATCH, OR ACTIVITY FOUND THROUGH OR COORDINATED ON THIS PLATFORM. YOU ARE SOLELY RESPONSIBLE FOR EVALUATING YOUR PHYSICAL FITNESS AND THE SUITABILITY OF ANY ACTIVITY FOR YOUR HEALTH CONDITION.

We strongly recommend consulting a physician before beginning any new physical activity program.

**Your content.** You retain ownership of content you submit to The Pickle Nest, including profile information, event listings, messages, and reviews ("User Content").

**License to us.** By submitting User Content, you grant The Pickle Nest a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display such content in connection with providing and promoting the Platform.

**Content standards.** User Content must not be illegal, obscene, defamatory, threatening, infringing of third-party rights, or otherwise objectionable. We may remove User Content that violates these standards at our discretion without notice.

**Accuracy.** You are solely responsible for the accuracy of User Content, including event times, locations, and other details. We do not verify the accuracy of User Content.

The Pickle Nest participates in affiliate marketing programs. Certain links to third-party gear, products, and services are affiliate links. When you click these links and make a purchase, we may earn a commission at no additional cost to you. Affiliate relationships do not influence our editorial rankings or picks, all recommendations are based on independent evaluation.

We may display sponsored content, advertisements, or promotional material from third parties. We are not responsible for the accuracy or content of third-party advertisements.

**Billing.** Premium subscriptions are billed monthly via Stripe. By subscribing, you authorize us to charge your payment method on a recurring monthly basis.

**Cancellation.** You may cancel your subscription at any time through the Settings page. Cancellation takes effect at the end of the current billing period. You will retain access to Premium features until the period ends.

**Refunds.** We do not provide refunds for partial billing periods. If you believe you were charged in error, contact us at support@thepicklenest.com within 30 days of the charge.

**Price changes.** We may change subscription prices with 30 days' notice. Continued use after the price change constitutes acceptance of the new price.

**Free tier.** The free tier is provided as-is and we reserve the right to modify or discontinue features in the free tier at any time.

The Platform integrates with or links to third-party services including Clerk (authentication), Stripe (payments), Google Analytics, and external retailers via affiliate links. These third-party services are governed by their own terms of service and privacy policies. We are not responsible for the practices, content, or availability of third-party services.

The Platform, including its design, text, graphics, logos, software, and content created by us (excluding User Content), is owned by or licensed to The Pickle Nest and is protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our proprietary content without express written permission.

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT: (A) THE PLATFORM WILL BE UNINTERRUPTED OR ERROR-FREE; (B) DEFECTS WILL BE CORRECTED; (C) THE PLATFORM OR SERVERS ARE FREE OF VIRUSES; OR (D) THE PLATFORM WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE PICKLE NEST AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: • Personal injury or death arising from pickleball games or activities • Property damage occurring during or related to events found on the Platform • Loss of profits, data, goodwill, or other intangible losses • Unauthorized access to or alteration of your data • Any damages arising from your reliance on information obtained through the Platform

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE GREATER OF (A) $100 OR (B) THE TOTAL AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for consequential damages, so some limitations above may not apply to you.

You agree to indemnify, defend, and hold harmless The Pickle Nest and its officers, directors, employees, agents, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Platform; (b) your User Content; (c) your violation of these Terms; (d) your violation of any rights of a third party; or (e) any activity you organize or participate in through the Platform.

These Terms are governed by and construed in accordance with the laws of the United States. Any dispute arising from or relating to these Terms or your use of the Platform shall first be submitted to informal negotiation. If informal negotiation fails, disputes shall be resolved by binding arbitration under the rules of the American Arbitration Association. Class action lawsuits and class-wide arbitration are not permitted.

Nothing in this section prevents either party from seeking injunctive or other equitable relief from a court of competent jurisdiction.

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. You may delete your account at any time through the Settings page. Upon termination, your right to use the Platform ceases immediately. Sections 5, 10, 11, 12, 13, and 14 survive termination.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new effective date and, where required, by sending an email notification. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
